About this Form:  This is a no-fault divorce form for use in Illinois (PETITION OF DISSOLUTION OF MARRIAGE). The majority of courts will require that this form be completed along with a Marital Settlement Agreement (Minor Children). Please note that in Paragraph 5 (Grounds for Divorce), the Petitioner will need to specify actual grounds for divorce that are recognized as valid in Illinois. Illinois law adheres only to the following grounds as adequate for granting a no-fault divorce: Irreconcilable differences that have caused the irretrievable breakdown of the marriage, and reconciliation has failed or further attempts are impractical; the spouses have been living separate and apart without cohabitation for 2 years. (Note: if both spouses consent, the required period for living separate and apart is 6 months.)
